1. About the Platform

Wathkam.lk is an online property listing marketplace that connects property sellers with prospective buyers and tenants in Sri Lanka. We are a platform, not a real estate agent. We do not own, manage, or sell any property listed on this Platform. All transactions are directly between the buyer and seller.

2. Eligibility

You must be at least 18 years old to submit a property listing or make an enquiry through this Platform. By using Wathkam.lk, you confirm that you meet this age requirement.

3. Property Listings

3.1 Submission

Any person may submit a property listing for review. All listings are subject to manual review and approval by the Wathkam admin team before appearing publicly. We reserve the right to reject any listing at our sole discretion without providing a reason.

3.2 Seller Responsibilities

By submitting a listing, you confirm that:

• You are the legal owner of the property, or are authorised by the owner to list it
• All information provided (price, location, size, photos) is accurate and not misleading
• You hold clear and undisputed title to the property
• You will respond honestly to buyer enquiries
• You will remove or request removal of the listing once the property is sold or rented

3.3 Prohibited Listings

You may not list:

• Property you do not own or have no authority to sell
• Property subject to unresolved legal disputes or government acquisition orders
• Fictitious or non-existent properties
• Listings with false or materially misleading information
• Duplicate listings of the same property

4. Buyer Responsibilities

Wathkam facilitates connections between buyers and sellers. We do not verify the accuracy of all listing details. As a buyer, you are responsible for:

• Conducting your own due diligence on any property before purchase
• Verifying title deeds, encumbrance certificates, and survey plans independently
• Using a licensed notary or lawyer for any property transaction
• Not relying solely on information shown on this Platform for financial decisions

5. Fees

Submitting a property listing on Wathkam.lk is currently free of charge during our launch phase. We reserve the right to introduce fees in the future. Any such changes will be communicated with reasonable notice.

6. Content Standards

All content submitted to Wathkam - including listing titles, descriptions, and photos must not:

• Be false, misleading, or fraudulent
• Contain offensive, defamatory, or illegal material
• Include personal data of third parties without their consent
• Contain external links to other websites in the listing description
• Violate any applicable Sri Lankan law or regulation

7. Intellectual Property

By submitting photos or other content to Wathkam, you grant us a non-exclusive, royalty-free licence to display, resize, compress, and use that content to operate the Platform. You retain ownership of your content.

The Wathkam.lk name, logo, and website design are the intellectual property of ADUNIS. You may not reproduce or use them without written permission.

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not guarantee that listings are accurate, complete, or current. We do not guarantee uninterrupted or error-free access to the Platform.

9. Limitation of Liability

To the maximum extent permitted by Sri Lankan law, ADUNIS shall not be liable for any direct, indirect, incidental, or consequential loss arising from your use of Wathkam.lk, including but not limited to losses from property transactions conducted through connections made on this Platform.

10. Termination

We reserve the right to remove any listing, suspend any account, or restrict access to the Platform at any time and without notice, particularly in cases of fraud, misrepresentation, or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes arising from your use of Wathkam.lk shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted on this page with a new date. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
